How is child support calculated in Canada?
Child support is calculated using the Federal Child Support Guidelines (FCSG), SOR/97-175. The amount is set by a table lookup based on the paying parent's gross annual income, the number of children, and the province or territory of residence. The 13 provincial and territorial tables are published in Schedule I of the Guidelines.
What about shared custody?
Where the payor exercises at least 40% of parenting time (FCSG s. 9), the court has discretion to depart from the table amount. The standard approach is the set-off — each parent's table amount for the other's income, then offset — with adjustments under Contino v. Leonelli-Contino, 2005 SCC 63 for the increased costs of shared custody and the parties' means and needs.
What about split custody?
Where each parent has primary custody of at least one child (FCSG s. 8), each parent's table amount for the children residing with the other is calculated, and the higher amount is reduced by the lower — producing a net monthly transfer.
What happens if income exceeds $150,000?
Above $150,000 (FCSG s. 4), the table amount is presumptively payable up to that ceiling, and the portion above is subject to judicial discretion having regard to the children's condition, means, needs and other circumstances. Francis v. Baker, [1999] 3 SCR 250 governs the discretion.
